Terminology: we, us, David Kendall Web Design, all refer to the company David Kendall Web Design and all associates, You, client, customer refers to all people procuring the services of David Kendall Web Design, 3rd Party refers to any person or company who is not David Kendall Web Design or the Client/customer.
Service is provided on the basis of aggrement to these terms and conditions.
Services provided will be set out in your quote, if you require services outside of what has been quoted for, these additional services must be paid for at the appropriate rate.
A non returnable deposit of 50% for projects under £1000 is payable upon commencemnt of your project, work will not be carried out until the deposit has been paid.
A non returnable deposit of 30% for projects over £1000 is payable upon commencemnt of your project, work will not be carried out until the deposit has been paid.
Copyright will remain the property of David Kendall Web Design until payment has been made in full.
The code powering your site will remain property of David Kendall Web Design, and may not be duplicated, distributed or altered without prior consent of David Kendall Web Design.
Late payment will be charged at an APR of 20% until settled in full for that installment.
Hosting accounts are to be set up in the name of the client and full responsibility for the payment of the hosting account is soley the responsibility of the client. If a project is held up due to non payment of hosting account by the client, payments to David Kendall Web Design must continue to be met on time.
No compensation will be made to clients for delays to a project caused by conditions beyond the control of David Kendall Web Design. this includes, server down time, change of specification by client, technical faults not caused by David Kendall Web Design, copyright disputes involving the client and a third party. and all other occasions of delay resulting from circumstances beyond the control of David Kendall Web Design.
The client may withdraw from using the services of David Kendall Web Design at any time providing 1 weeks notice in writing, If a deposit has been paid this WILL NOT BE REFUNDED, any work carried out that is not covered by the initial deposit will be charged for at the appropriate rate in accordance with the clients quote, this figure must be paid for by the client before release from this contract.
